The Nigeria Social Insurance Trust Fund (NSITF) has recorded a major legal victory after the National Industrial Court of Nigeria (NICN) affirmed its authority to enforce compliance with the Employees’ Compensation Act (ECA), 2010.

In a landmark judgment delivered on June 4, 2026, in Suit No. NICN/AWK/56/2025, the Awka Judicial Division of the court upheld claims brought by the NSITF against an employer accused of failing to meet its statutory obligations under the Employees’ Compensation Scheme (ECS).

The ruling is widely regarded as a significant boost to the implementation of the Employees’ Compensation Act, reinforcing the legal requirement for employers to register with the Scheme and make the prescribed contributions aimed at protecting workers against workplace injuries, disabilities, diseases, and death.

The court’s decision underscores the importance of compliance with the law and sends a strong message to employers across the country that participation in the Employees’ Compensation Scheme is not optional but a statutory obligation designed to safeguard the welfare of Nigerian workers.

Reacting to the judgment, the NSITF described the verdict as a milestone in its ongoing efforts to deepen compliance, expand coverage, and ensure that employees enjoy the full benefits and protections guaranteed under the Act.

The Fund noted that the ruling further validates its mandate to enforce the provisions of the Employees’ Compensation Act and strengthens its resolve to pursue employers who fail to comply with the law.

Industry observers say the judgment could serve as a precedent in future enforcement actions, while also encouraging greater adherence to workplace compensation regulations nationwide.

The Employees’ Compensation Scheme, administered by the NSITF, provides compensation and rehabilitation support to workers who suffer occupational injuries or diseases in the course of their employment, while also offering benefits to dependants of deceased employees.

With the latest court victory, the Fund has reinforced its commitment to protecting Nigerian workers and promoting a culture of compliance that guarantees safer and more secure workplaces across the country.
